NEW YORK (AP) - The federal judge presiding over challenges to Google Inc.'s plans to create the world's largest digital library has refused to delay the 7-year-old case while Google appeals his decision to grant authors class certification.

U.S. Circuit Judge Denny Chin's order was put in the court file Wednesday in Manhattan, where he ruled in May that class action was "more efficient and effective" than requiring thousands of authors to sue individually. His order was dated Tuesday.

The Mountain View-Calif.-based Google appealed the class-certification ruling and asked to delay all proceedings until the 2nd U.S. Circuit Court of Appeals rules.

Chin said a delay was unwarranted, especially since it would hold the case up for a year or more.

"The merits would have to be reached at some point in any event, and there simply is no good reason to delay matters further," the judge wrote.

He also said he found it surprising that Google argued it would be unfair to decide the merits of the case while authors were deciding whether to opt out of the class, especially "in light of Google's fervent opposition to class certification."

Chin has scheduled oral argument for October on requests by lawyers that he decide issues without a jury.

Google already has scanned more than 20 million books for the project. The Authors Guild had requested class certification, saying it was impractical and expensive for each author to sue Google over similar claims.

The Authors Guild has asked in court papers that the class be awarded $750 in damages for each copyrighted book Google copied. It has argued that Google was not making "fair use" of copyright material by offering snippets of works in its online library.

Lawyers for Google did not immediately respond to a message for comment. The company that operates the world's largest Internet search engine has defended its online library plans, saying it is fully compliant with copyright law.

(Reuters) - After initially criticizing Nasdaq OMX Group for its response to Facebook's botched initial public offering, trading firm Knight Capital Group Inc said it accepted the exchange's latest plan to pay back brokers a portion of their losses.

Knight's support comes after Nasdaq increased the payback fund to $62 million in cash from an earlier $40 million made up mostly of trading rebates, the market-making firm said in a letter to the U.S. Securities and Exchange Commission, dated August 29.

Knight, which facilitates trades for other firms, had called Nasdaq's earlier plan "inadequate," and said it was considering legal action over the May 18 IPO.

"Although we would have preferred that the accommodation pool cover all losses sustained by Nasdaq members, we do support Nasdaq's proposal to increase the accommodation pool from $40 million to $62 million," Knight said in the letter obtained by Reuters.

Knight and other retail market-making firms and brokers together lost more than $500 million in the IPO.

Some firms, like UBS AG, which disclosed it lost more than $350 million, and Citigroup's Automated Trading Desk, which is said to have lost up to $35 million, have rejected the plan, saying Nasdaq should be responsible for all of the losses, because it acted in a for-profit manner in the IPO.

Liabilities at U.S. exchanges, which have some regulatory duties, are capped in most instances. Nasdaq's cap is $3 million a month.

Knight said it lost more than $35 million in the IPO, but it urged the SEC to leave the discussion of liability limitations and regulatory immunity to another day.

Citadel Securities, which is said to have lost $20 million, has also voiced support for the plan.

Still, Knight urged the SEC to reject a portion of Nasdaq's plan, which would require firms that sign on to waive their right to sue the exchange, a requirement Knight called "misplaced."

"Setting forth those types of requirements in the context of a rule filing inappropriately mixes commercial issues with regulatory requirements," Knight said in the three-page letter also addressed to SEC Chairman Mary Schapiro.

It said if the SEC disagrees and determines that some form of release is appropriate, it should only be sought after Nasdaq members are notified of the amount Nasdaq is willing to pay under the terms of the accommodation plan.

TBILISI, Georgia (AP) ? At least 3 Georgian commandos and 11 militants have been killed during an operation to free hostages held along Georgia's border with Russia, authorities said Wednesday.

SAN ANTONIO (AP) ? The future of Texas' voting districts is again in question after a federal court Tuesday found evidence of discrimination in new district maps approved by the state's Republican-controlled Legislature last year.

The U.S. District Court in Washington wrote in a 154-page opinion that the maps don't comply with the federal Voting Rights Act because state prosecutors failed to prove that Texas lawmakers did not draw the new congressional and state Senate districts "without discriminatory purposes."

The ruling applies to the maps originally drawn by the Legislature in 2011, and not interim maps drawn by a San Antonio federal court that are to be used in the upcoming elections this November. The Washington court's Tuesday decision is most likely to impact the maps that will be used in the next election cycle in 2014.

Luis Vera, an attorney for the League of United Latin American Citizens, called the ruling "better late than never" and a win for his and other minority rights groups that sued the state over the maps.

"The three-judge panel unanimously found intentional discrimination across the state. There's no ifs, ands, or buts about it," Vera said.

Texas Attorney General Greg Abbott immediately vowed to appeal to the U.S. Supreme Court.

"Today's decision extends the Voting Rights Act beyond the limits intended by Congress and beyond the boundaries imposed by the Constitution," Abbott said in a statement.

How Texas redrew its political boundaries was closely watched after the state was awarded four additional U.S. House seats based on a booming population largely driven by minorities. Those congressional seats were carved equally into two safely Republican and two safely Democratic districts.

The ruling is the latest in a process that started in June 2011, when the Texas Legislature passed new political maps but failed to get them "pre-cleared" by the Justice department. That's required under the federal Voting Rights Act which calls for Texas and eight other, predominantly southern, states with a history of racial bias to submit their political maps to the Justice Department for compliance.

But rather than submit the maps to the department, the state chose to seek preclearance through the Washington court.

Nina Perales, attorney for the Mexican American Legal Defense and Education Fund, said Tuesday's ruling seems to show the state's strategy backfired. MALDEF also was one of the groups that sued the state.

"It seems that Texas risked and lost more by going to the D.C. court than by going to DOJ," Perales said. "Particularly when you factor in the enormous expense of litigating a redistricting case."

The ruling comes months after lawyers for the state of Texas, the Justice Department and minority groups argued their sides in front of a three-judge panel in Washington. The two-week trial included dozens of witnesses as well as thousands of pages of documents on the redistricting process.

Texas' argument boiled down to politics: The state's lawyers said the map crafted by the Legislature reflected a GOP majority seeking to squeeze a partisan advantage out of the once-a-decade redistricting process, not a willful disregard for the Voting Rights Act. The state also maintained that lawmakers kept a cool distance from the process, leaving much of the work of drawing districts to legislative staff.

Through the trial, the three-judge panel appeared skeptical of Texas' arguments. The presiding judge, Rosemary Collyer, at one point told Texas' lawyers flatly, "It's really hard to explain (changes to the map) other than doing it on the basis of reducing minority votes."

Property values always go up.

Or at least that?s what people believed.

For years, values have consistently climbed higher and higher at an average rate of around 5% per year. Real estate investors rely heavily on price appreciation to maximize their investment for the future. I know that I personally hope my properties will continue to climb in value for many years and I?ll be able to retire before I hit thirty-five.

But what if values don?t increase?

It?s a question worth asking. When you buy a property, you have a lot of control. You can decide many things, such as:

Where To Buy
How Much To Pay
How Much To Improve The Property

However, you do not have control over the future value. While we can hope that property values will continue to rise ? there is no guarantee.

So what happens if property prices stay level? What if they never improve? What if they decline? How does that affect your investing? I want to look quickly at three aspects related to this scenario and explain why real estate investing does not, and should not, simply rely on appreciation for success.

1.) Mortgage Still Being Paid Off

Even if prices never climbed any higher, unless you purchase a property with an interest-only loan, the mortgage balance is still decreasing each and every month. This means next month you will owe less than today, and today you owe less than last month. If you amortized the loan over a thirty-year period, then in thirty years you will owe nothing. Even if your property hasn?t doubled or tripled in value by then you still have significant equity and cashflow.

This is a good reason why, depending on your investment strategy, constantly refinancing and pulling out equity may not be a wise decision. I know there are math nerds out there that will tell me how if I pull out equity at 5% and make a 10% return-on-investment on that money I will be richer. I understand the math (after all, I was president of my high school Math Club?)

The problem is, as Dave Ramsey likes to say, 100% of all foreclosures last year happened to people with mortgages. Don?t get me wrong ? I?m not suggesting you shouldn?t finance your properties (though, paying all cash for them is not a bad way to invest if you have the funds). I am, however, encouraging you to look at the long term picture and think of the end game. If prices never climbed, in thirty (or fewer) years you will own a piece of property that is free and clear but producing income.

2.) More Incentive To Make Your Money At The Purchase

You?ve heard the quote, ?A rising tide lifts all ships.? This is what appreciation is ? a rising tide. It?s also an excuse to invest lazily, assuming the market will bail you out. In the frenzy which was the real estate market in the mid 2000s there were ?gurus? out there advocating spending ANY amount to buy a property, because the market would eventually catch up. Thousands of investors lost everything because of this mentality when the market didn?t just stop climbing ? it fell (and fell hard).

Warren Buffet is famous for saying, ?Only when the tide goes out do you discover who?s been swimming naked.?

This is what happens when investors rely on appreciation to save them rather than relying on cold hard facts and figures. When I invest, I buy property with the assumption that it will NEVER climb in value. Never. Appreciation is the icing on the cake, not the freight train to freedom. If my property was suddenly worth double what I paid, I would be ecstatic. However, if it stayed the same or even decreased ? it doesn?t change the fact that I bought correctly and the cashflow is still proving income day in and day out. This is the story behind my favorite property, the Kurt Cobain duplex.

Don?t make the same mistake as the thousands of investors who followed the gurus and lazily invested in anything. Stick to strict buying standards and make your money when you buy ? not when you sell.

3.) You Can Always Find Ways to Force Appreciation

The ?market? is NOT your property. Each property is different and comes with a different set of challenges and opportunities. Don?t assume that just because ?the market? isn?t improving that your own property can?t increase in value either. There are hundreds of ways to maximize your property and increase the value without relying on real estate appreciation. Even if value does not increase, and I may not be able to retire by thirty-five (and what would I do then but continue my passion of investing in real estate?), I still am able to ensure success and minimize the risk down to almost none. To me, that is more important than the hope that prices will rise forever.

ScienceDaily (Aug. 25, 2012) ? Many European countries have passed anti-smoking legislation which bans smoking from restaurants, bars and public buildings. After implementation of such a smoking ban on 1 January 2008 in the metropolitan area of Bremen in northwest Germany (800,000 inhabitants) a 16% decline in ST-elevation myocardial infarction (STEMI) was observed. STEMI is the severest form of myocardial infarction.

For the study, 3,545 STEMIs in the Bremen-STEMI-Registry which occurred between 2006 and 2010 were analyzed.? Dr Schmucker said: "There were more non-smokers than smokers, which explains why the non-smokers group had more STEMIs registered."

For the total population in 2006 and 2007, before the smoking ban was passed, averages of 65 STEMIs were registered per month. In 2008 to 2010, after the smoking ban was passed, the number fell by 16% to an average of 55 STEMIs per month. "This confirms that the smoking ban had a positive impact on the population as a whole by decreasing the number of STEMIs," said Dr Schmucker.

A nearly constant rate of STEMIs was observed in active smokers during 2006-2010. In 2006-2007 active smokers had an average of 25 STEMIs per month. In 2008-2010, they had an average of 26 STEMIs per month, a 4% increase. Dr Schmucker said: "Active smokers are inhaling such high doses of tobacco smoke that being exposed to less passive smoke in public venues is not going to change the risk for that particular group."

In non-smokers there was a 26% decrease in STEMIs, from an average of 39 STEMIs per month in 2006-2007 to an average of 29 STEMIs per month in 2008-2010. The steepest decline in the non-smoking group was detected in young non-smokers; in this group the average number of STEMIs per month was 31% lower in 2008-2010 compared to 2006-2007.

"The reduction in the occurrence of this severest and deadliest form of myocardial infarction in the metropolitan area of Bremen can be partially attributed to the commencement of anti-smoking legislation," said Dr Schmucker. "Non-smokers and especially non-smokers under the age of 65 benefited most from the implementation of the law, indicating the harmful effects of passive smoking. This suggests that expanding anti-smoking legislation could reduce the occurrence of STEMIs even further in the future."

SAN JUAN, Puerto Rico?Tropical Storm Isaac strengthened slightly as it spun toward the Dominican Republic and Haiti, but seemed unlikely to gain enough steam early Friday to strike the island of Hispaniola as a hurricane.

The storm's failure to gain the kind of strength in the Caribbean that forecasters initially projected made it more likely that Isaac won't become a hurricane until it enters the Gulf of Mexico, said Eric Blake, a forecaster with U.S. National Hurricane Center in Miami.

"We think it could become a hurricane on Monday," Blake said late Thursday. "It would be somewhere over the Gulf of Mexico."

The latest five-day forecast showed the storm's path shifting to the west, possibly making landfall near the Alabama-Mississippi border, Blake said. But he said it was "too early to know" the exact course and stressed that Florida's Gulf Coast, including Tampa, the site of next week's Republican National Convention, was still in the forecast cone.

The storm dumped heavy rain Thursday across eastern and southern Puerto Rico and whipped up waves as high as 10 feet (3 meters) in the Caribbean as it churned across the region.

Late Thursdsay night, Isaac was centered about 145 miles (235 kilometers) south-southeast of Santo Domingo, Dominican Republic, and had maximum sustained winds of 45 mph (75 kph). It was moving west-northwest at 18 mph (30 kph), according to the hurricane center.

In flood-prone Haiti, Prime Minister Laurent Lamothe urged people to avoid crossing rivers, to tape their windows, and to stay calm, saying "panic creates more problems."

Lamothe and other Haitian officials said the government had set aside about $50,000 in emergency funds and had buses and 32 boats on standby for evacuations.

But among many Haitians, the notion of disaster preparedness in a country where most people get by on about $2 a day was met with a shrug.

In the Dominican Republic, authorities began to evacuate people from low-lying areas but encountered resistance.

"Nobody wants to leave their homes for fear they'll get robbed," said Francisco Mateo, community leader of the impoverished La Cienaga neighborhood in Santo Domingo, the capital.

The Dominican government planned to close all of the country's nine airports by dawn Friday, said Alejandro Herrera, civil aviation director. Schools closed by Thursday afternoon.

The storm's approach prompted military authorities at the U.S. base in Guantanamo Bay, Cuba, to cancel pretrial hearings for five prisoners charged in the Sept. 11 attacks. They also evacuated about 200 people, including legal teams and relatives of Sept. 11 victims.

Blake, the U.S. forecasts, said that while Isaac hadn't strengthened much in the Caribbean, it could gain power as it moves away from Cuba. "When it moves back over water, it has a chance to restrengthen," he said.

Organizers of next week's Republican National Convention in Tampa were working closely with state and federal authorities on monitoring storm as they prepared for the arrival of 70,000 delegates, journalists and protesters.

"We continue to move forward with our planning and look forward to a successful convention," convention CEO William Harris said in a statement.

Florida Gov. Rick Scott said RNC officials had consulted with state, local and federal authorities and there were no plans to cancel the convention.

Out in the eastern Atlantic, another tropical storm, Joyce, was downgraded to a tropical depression late Thursday, and posed no threat to land. The hurricane center in Miami said Joyce had maximum sustained winds of 35 mph (55 kph) and that it was becoming disorganized.

Jones also said he doesn?t agree with those who believe NFL refereeing needs to be a full-time job, which seems to put him at odds with some of the owners, who have suggested that a new deal with the NFL Referees? Association would include at least some of the refs agreeing to give up their other jobs and devote all of their time to officiating.

?I think we get better people by having officials that don?t make it full time,? Jones said. ?When you only are officiating 16 games a year, plus the playoff games, it doesn?t warrant full-time officials.?

Ultimately, Jones said, he hasn?t noticed any difference with replacements, and he said he thinks that if there are mistakes on the field, instant replay should be able to get it right.

?I haven?t, really, because I can take any game at this juncture in any year and come up with criticism of the officiating,? Jones said. ?It?s subjective in so many areas, and we?ve got in place a pretty good backup system now with our replays, and when it?s replayed. If anything, I?ve seen in a couple of our games the replay procedure needs improvement. . . . That has, in my mind, nothing to do with these replacement officials.?

Jones sounds like he?s convinced that the officials? lockout could go on indefinitely without affecting the NFL. Something tells me he?ll change his mind if a bad call from a replacement official costs the Cowboys a game.

Researchers, led by Allison Golnik, MD, of the Department of Pediatrics at the University of Minnesota, asked parents of kids with autism about their doctor?s style.

They sent surveys to 203 parents of kids with autism between the ages of 3 and 18. Of the surveys sent out, 103 parents, or 64 percent, sent their survey back to the researchers.

The survey asked parents about how much they asked their doctor for information on autism. It also asked about their satisfaction with the care their child was getting.

Parents were also asked to rate how often their child?s doctor told them about the options and talked about the reasons for and against any options.

They were also asked to rate how often the doctor gave them a choice of treatments and asked them to weigh in on the decisions.

They found that parents who felt they were part of the decision-making for their child also reported being happier with care.

Parents with higher levels of shared decision-making were also more likely to say they felt informed about their child?s care.

The study was published in August in Intellectual and Developmental Disabilities.? Funding for this study was provided by the Minnesota Department of Human Services.
